About these terms
These terms apply when you use the Vanquish Seed online store (the “Store”) and when you place an order. The Store is operated by RALU ADVERTISING LLC (“we,” “us,” or “our”).
By using the Store or placing an order, you agree to these terms and to the policies they mention: the shipping policy, the refund policy, and the privacy policy. If you do not agree, do not use the Store.
The Store is built on Shopify. Shopify provides the platform and the checkout, and we sell the products.
Who can buy
To place an order, you must be old enough to enter a binding contract where you live, and have a shipping address in the United States.
The product
The Store sells softgels of oil from the seeds of Nigella sativa, 60 softgels per bottle. You can buy 1 bottle, or a pack of 3 or 5 bottles.
Read the label and the precautions on the product page before use.
If the bottle you receive does not match the product page, write to us with your order number. The refund policy sets out what we do next.
Orders
Every order is a one-time purchase. You pay once, for the order you place, and nothing renews.
Your order is an offer to buy. The order confirmation we email you, from Vanquish Seed, tells you we received it. We accept your order when we ship it.
We may decline or cancel an order, for example if the product is out of stock, if we suspect fraud or an unauthorized payment, if the shipping address is outside the area we deliver to, or if a price on the Store is wrong. If we cancel an order you have paid for, we refund the full amount to your payment method and tell you by email.
Prices and taxes
Prices are in US dollars and are shown on the product page. Prices exclude sales tax, calculated at checkout. Checkout shows shipping and any sales tax before you pay.
We may change prices at any time. A price change never affects an order you have already paid for. If a price was wrong, we may cancel the order and refund it in full, as described above.
Payment
You pay through Shopify’s encrypted checkout, with the payment methods it shows. Our payment processors handle each payment. By placing an order, you confirm that you are allowed to use the payment method you choose, and you authorize us to charge it for the order total.
Delivery
Delivered in 1 to 2 business days anywhere in the US. Orders ship from US warehouses. The shipping policy covers where we deliver and what shipping costs.
Refunds
Every order comes with our 30-day money-back guarantee on unopened bottles. Its full terms are in the refund policy, which is part of these terms.
Using the Store
You may use the Store only for lawful purposes. When you use the Store, you agree not to:
- break any law or infringe anyone else’s rights;
- give false information, or use a payment method you are not allowed to use;
- try to reach parts of the Store, its systems, or other customers’ data that are not open to you;
- interfere with how the Store works, including by sending harmful code or overloading it;
- copy large parts of the Store with automated tools, or copy its content for commercial use without our written permission.
Suspension
We may suspend or end your access to the Store if you break these terms.
Content and names
The Store’s text, images, logos, and design, and the name “Vanquish Seed,” may be used only with our written permission.
Other services
The Store links to services run by others, such as Shopify, payment processors, and shipping carriers. Their own terms and privacy policies apply to those services, and we are not responsible for them.
Electronic communications
When you place an order, you agree to receive order emails and notices about these terms by email. These emails meet any legal requirement that such notices be in writing.
Delays beyond our control
We are not responsible for delays caused by events outside our reasonable control, such as severe weather, carrier disruptions, and power outages. If such an event delays your order, we email you, and you can cancel it for a full refund.
Disclaimer of warranties
Your rights for the product are those set out in the refund policy and those the law gives you. To the fullest extent the law allows, the Store and its content are provided “as is” and “as available.” For the Store and its content, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. This does not limit the implied warranties the law gives you for the product. We do not promise that the Store will always be available or without errors. Some states do not allow these exclusions, so they may not apply to you.
Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of the Store or the product. To the same extent, our total liability for any claim about an order is limited to the amount you paid for that order. These limits do not apply to personal injury or to our gross negligence. Nothing in these terms limits a liability that the law does not allow us to limit.
Indemnity
To the extent the law allows, you agree to cover our reasonable losses and costs, including legal fees, from any claim by someone else caused by your breach of these terms or your misuse of the Store.
Governing law and disputes
These terms are governed by the laws of the State of Texas and applicable US federal law, without regard to conflict of law rules.
If you have a problem with an order, contact us first. Our team replies within 24 to 48 hours. We work with you to settle it by email.
If we cannot settle a dispute, it will be heard by the state or federal courts located in Hidalgo County, Texas, and you and we agree to their jurisdiction. You can also bring a claim in small claims court in the county where you live, if it qualifies.
Nothing in these terms takes away rights you have under the consumer protection laws of your state that cannot be waived by contract.
Changes to these terms
We may update these terms. The version posted when you place an order applies to that order.
General
If a court finds part of these terms unenforceable, the rest stays in effect. If we do not enforce a term right away, we can still enforce it later. These terms, with the policies they mention, are the whole agreement between you and us about the Store and your orders. We may transfer our rights and duties under these terms to a business that takes over the Store.
